Terms and conditions
==================================================
GUIDELINES
==================================================
Community guidelines
If you have any feedback or suggestions, we would love to hear from you at [email protected], so that we can continue to provide the best possible service.
Culture
As part of The 350 Club community, we ask that you are helpful to your peers and respond to requests for advice or information wherever possible.
The Club is not a place to seek roles, other than those officially posted in the Vacancies section, and solicitation is not permitted. This will be strictly enforced. By "solicitation" we mean contacting other Members to ask to be considered for roles, unless those Members have clearly indicated that this is appropriate (for example, as part of a pre-existing discussion). Members should be able to come to the Club for information and connection without receiving unsolicited approaches.
Community rules
When you use The 350 Club, you agree to abide by the following rules at all times. You also agree not to encourage others to break them.
1. You must use your real name and identity on the Service.
2. You must be, or have been, a FTSE 350 board member, a FTSE 100 executive committee member or equivalent, unless you have been invited by Club management or under our digital or diversity criteria.
3. You must not engage in solicitation, abuse, bullying, disrespectful behaviour or harassment of any Member or event host.
4. You must not discriminate against, engage in hateful conduct directed at, or threaten violence or harm against any person or group of people.
5. You must not share, threaten to share, or encourage the sharing of other people's private information without their explicit, prior written permission.
6. You must not engage in intentionally disruptive activity that negatively affects other Members' experience.
7. All conversations are held under the Chatham House Rule. This is a key pillar of the Club and its effectiveness. You must not, under any circumstances, transcribe, record or otherwise reproduce or share information obtained in the Club without prior permission.
8. You must not hold any conversation or upload any content that infringes any intellectual property or other proprietary rights.
9. You must not spread false information or spam, or artificially amplify or suppress information.
10. You must not share or promote information (including synthetic or manipulated media) that is intended or likely to cause harm to any person, group of people or business.
11. You must not use the Service for any unauthorised or illegal activity.
12. Members whose portfolios change, leaving them without a FTSE 350 non-executive director or FTSE 100 executive committee role, have 18 months to secure another such role, after which The 350 Club may remove them from the platform.
If you witness a breach of these rules, please report it as described below.
Follow this link for our Privacy Policy.
Incident reporting
We expect incidents to be very rare.
To report an incident, please email [email protected], telling us who you wish to report and why, and the best contact details for reaching you.
If another Member reports you for breaching these rules:
1. If your membership is flagged for a potential breach, you may be temporarily or permanently restricted or removed from the Club.
2. If you believe you did not breach our rules, contact us at [email protected], including your verified email address and a reference to the original notification you received.
Legal note
You are solely responsible for your interactions with other Members, and you agree that we have no liability or responsibility for those interactions.
We understand that not all Members will share our view of what constitutes a breach of these Community Guidelines. However, to operate a functional platform, we must reserve the right to determine, in our sole discretion, what constitutes a breach.
Our failure to enforce these Community Guidelines in any particular instance does not amount to a waiver of our rights under our Terms of Service or these Community Guidelines.
We reserve the right, in our sole discretion, to change any part of these Community Guidelines at any time. If we do, we will post the changes on this page and show at the top of the page the date they were last updated.

You are eligible to use the Services if you are a FTSE 350 board member, a FTSE 100 executive committee member or equivalent, or one of a small group of Curated Members nominated by Club management for diversity purposes. Membership is offered at the discretion of The 350 Club administration team.

Registration and your information
To use the Club, you must create an account (an "Account") for identity and application purposes. If we have reasonable doubts about your identity, we will suspend or close your Account to protect the wider membership. Please provide accurate information that is as complete and up to date as possible, and update it as needed. This helps both us and your fellow Members. You agree never to disclose your Account password to anyone and to notify us immediately of any unauthorised use of your Account. You are responsible for all activity that occurs under your Account, whether or not you are aware of it.
General practices regarding use and storage

The Service includes certain services available via a mobile device, including (a) the ability to upload content to the Service, (b) the ability to browse and use the Service and the Site, and (c) the ability to access certain features through a web app (together, the "Mobile Services"). If you access the Service through a mobile device, your carrier's standard charges, data rates and other fees may apply. Downloading, installing or using certain Mobile Services may also be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices. By using the Mobile Services, you agree that we may contact you about The 350 Club, for example about forthcoming events, by SMS, MMS or other electronic means, and that certain information about your use of the Mobile Services may be shared with us. We will try not to be intrusive in this regard. If you change or deactivate your mobile number, you agree to update your account information promptly so that our messages are not sent to whoever acquires your old number.

Club terms and conditions
--------------------------------------------------
1. Club name
The name of the club is "The 350 Club" (the "Club"), owned and operated by The 350 Club (the "Proprietor").
2. Club rules
These Club rules (the "Rules") set out the terms and conditions of membership and are intended to safeguard the effectiveness, security and enjoyment of the Club for its Members.
3. Confidentiality
The Club's management and staff adhere to the strictest standards of confidentiality and undertake to keep all records and personal information about Members and their guests in the strictest confidence. This information will never be disclosed for any purpose other than as required by law or as described in our Privacy Policy. We may send Members messages about matters likely to be relevant and of interest to them, such as job vacancies.
4. Objectives of the Club
The objective of the Club is to provide content and connection, digitally and possibly in due course in person, so that board and executive committee members of FTSE 350 companies can connect, learn and collaborate.
5. Control and management
The Membership Committee has all administrative powers necessary to pursue the Objectives of the Club in accordance with these Rules and the Club's requirements.
6. Becoming a Member
Anyone applying for membership (a "Candidate") must complete a written application form (an "Application").
Any material inaccuracy in the particulars or description of a Candidate may render their election void at the discretion of the Proprietor. The Proprietor may refuse any Application for any reason without giving an explanation.
Members may propose potential Candidates. Management's decision on their election is final and binding. Every Candidate must be at least 18 years of age.
All personal information is held in accordance with our Privacy Policy.
7. Cancelling an application or membership
A Candidate may withdraw their Application at any time before it is accepted. Members may cancel their membership at any time by contacting Club management.
8. Membership
Membership is non-transferable. Successful Candidates will be notified of their election and will then become Members of the Club, entitled to all the benefits and privileges of membership. All Members agree to be bound by, and to observe at all times, the Club Rules and Culture.
9. Termination of membership
When a Member's membership is terminated, their name will be removed from the list of registered Members, but not from the Membership Directory if they qualify for inclusion as a FTSE 350 board member or FTSE 100 executive committee member. The Membership Committee reserves the right, in its absolute discretion, to terminate any Member's membership for any reason, at any time and without notice. Conduct of the kind described in paragraph 11 will result in suspension or termination of membership. The Club's decision in this regard is final.
10. Suspension
The Club may, at its sole discretion, suspend a membership (that is, put it on hold) if a Member is reported for activity that may breach the Rules or Culture and an investigation is required or under way.
As Club policy does not permit the usual use of recordings, in order to protect Members' privacy, a Member may be asked to provide evidence and agrees to do so.
11. Conduct of Members
All Members and guests must maintain a standard of behaviour appropriate to the Objectives and quality of the Club and to the security and protection of its Members.
Members are solely responsible for all audio, video, images, information, data, text, music, sound, photographs, graphics, messages or other materials ("Content") that they upload, post, publish or display (together, "upload"), email or otherwise use via the Club. The examples below describe the kinds of Content and use that are illegal or prohibited by The 350 Club. The 350 Club reserves the right to investigate and take appropriate action against anyone who, in its sole discretion, breaches this paragraph, including removing the offending Content from the Club, suspending or terminating the Member's account, and taking any other action it sees fit.
You agree not to use the Club, under any circumstances, to:
(a) hold any conversation or upload any Content that:
(i) infringes any intellectual property or other proprietary rights of any party;
(ii) you do not have a right to upload under any law or under contractual or fiduciary relationships;
(iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment;
(iv) poses or creates a privacy or security risk to any person;
(v) constitutes unsolicited or unauthorised advertising, promotional materials, commercial activity or sales, "junk mail", "spam", "chain letters", "pyramid schemes", "contests" or "sweepstakes";
(vi) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libellous, invasive of another's privacy, or racially, ethnically or otherwise hateful or objectionable; or
(vii) in the sole judgement of The 350 Club is objectionable, restricts or inhibits any other person from using or enjoying the Service, or may expose The 350 Club or its Members to harm or liability of any kind;
(b) post a role in the Vacancies section that does not name an associated headhunter or search firm (we welcome vacancies that do);
(c) record any part of a conversation without the express consent of all the speakers involved;
(d) interfere with or disrupt the Service or the servers or networks connected to the Club, or disobey any requirements, procedures, policies or regulations of networks connected to the Club;
(e) breach any applicable local, national or international law, or any regulation having the force of law;
(f) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
(g) solicit personal information from anyone under the age of 18;
(h) harvest or collect email addresses or other contact information of other users from the Service, by electronic or other means, in order to send unsolicited emails or other communications or for any commercial or other purpose;
(i) advertise, or offer to sell or buy, any goods or services;
(j) promote or help build a competing product or service, copy the Service's features or user interface, or solicit users or customers from the Club;
(k) further or promote any criminal activity or enterprise, or provide instructional information about illegal activities; or
(l) obtain, or attempt to access or obtain, any materials or information by any means not intentionally made available through the Service.
You also agree to treat all information gained in rooms on The 350 Club, or elsewhere in the Club, as strictly confidential. The Chatham House Rule applies throughout the Club.
Courses
The 350 Club reserves the right to remove any Member from a course if they do not adhere to the Community Guidelines while taking part. Members agree to:
(a) adhere to the Community Guidelines, online and offline, during every course session;
(b) use the private course group strictly for the course's purpose;
(c) not solicit the course's attendees or hosts; and
(d) not record, or share with any third party, any content from the closed course group.
Commercial use
Unless expressly authorised in these Terms or in the Service, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purpose any part of the Service, use of the Service or access to the Service. The Service is for your personal use for connection and development.
12. Withdrawal of membership
Management, a designated Membership Committee, or any Club manager or employee authorised by the Membership Committee may terminate a Member's membership, or suspend it for a specific period, if in their opinion the Member's conduct inside or outside the Club might be injurious to the character or interests of the Club or render them unfit to associate with Members.
Before a Member is suspended or their membership terminated, the alleged conduct will be investigated and the Member will be given the opportunity to explain it. If, having investigated, Management considers that the Member has behaved contrary to the spirit of the Membership Rules and Culture and has failed to justify or explain that behaviour satisfactorily, the Membership Committee may suspend or terminate their membership at its discretion.
13. Cameras and recording devices
Members are not permitted, on any grounds, to record, livestream or distribute any content from within rooms. This protects the security and privacy of all Members. Any Member found doing so will have their membership terminated.
The Club may in due course record keynote events and interviews, solely to make them available privately to Members for later viewing, and only on The 350 Club site. Any keynote event or interview being recorded will be clearly flagged as such, and every speaker's permission will be obtained before the recording is uploaded. No content from rooms will ever be made available to an external party, unless Management is required to do so for unavoidable legal reasons.
14. Press and social media
To protect the privacy of the wider membership, Members must not disclose or identify any other Member of the Club in the press or on social media, including Facebook, X (formerly Twitter), Instagram and personal blogs, without that Member's permission. Members may refer to the Club itself. Breach of this Rule may result in suspension or termination of membership.
15. Intellectual property rights
Service Content, Software and Trademarks
You acknowledge and agree that the Club may contain content or features ("Service Content") protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorised by The 350 Club, you agree not to modify, copy, frame, scrape, rent, lease, lend, sell, distribute or create derivative works based on the Service or the Service Content, in whole or in part. In using the Service, you will not use any data mining, robots, scraping or similar data gathering or extraction methods. If The 350 Club blocks you from accessing the Service (including by blocking your IP address), you agree not to take any measures to get around that block (for example, by masking your IP address or using a proxy IP address). Any use of the Service or the Service Content other than as specifically authorised in these Terms is strictly prohibited.
The technology and software underlying or distributed with the Service (the "Software") are the property of The 350 Club, our affiliates and our partners. You, and any non-member intermediaries, agree not to copy, modify, create derivative works of, reverse engineer, reverse assemble or otherwise attempt to discover any source code of, sell, assign, sublicense or otherwise transfer any right in the Software. Any rights not expressly granted in these Terms are reserved by The 350 Club.
The 350 Club name and logos are trademarks and service marks of The 350 Club (the "350 Club Trademarks"). Other product names, service names and logos used and displayed via the Service may be trademarks or service marks of their respective owners, who may or may not endorse or be affiliated with or connected to The 350 Club. Nothing in these Terms or the Service grants, by implication, estoppel or otherwise, any licence or right to use any of the 350 Club Trademarks, and any use of trademarks displayed on the Service is prohibited without the prior written permission of The 350 Club in each instance.
Third-party material
Under no circumstances will The 350 Club be liable in any way for any content or materials of third parties (including users), including any errors or omissions in such content, or any loss or damage of any kind incurred as a result of using it. You acknowledge that, particularly given its live functionality, The 350 Club does not pre-screen content, but that The 350 Club and its designees have the right (but not the obligation), in their sole discretion, to refuse or remove any content available on the Club site. Without limiting the foregoing, The 350 Club and its designees may remove any content that breaches these Terms or that The 350 Club, in its sole discretion, considers otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on its accuracy, completeness or usefulness.
User Content transmitted through the Service
For any content or other materials you upload through the Service or share with other users or recipients (together, "User Content"), you represent and warrant that you own, where required, all right, title and interest in and to that User Content, including all copyrights and rights of publicity. By uploading any User Content, you grant The 350 Club and its affiliated companies a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable, perpetual and irrevocable licence to copy, display, upload, perform, distribute, store, modify and otherwise use your User Content in connection with operating the Service or promoting, advertising or marketing it, in any form, medium or technology now known or later developed.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Service that you provide to The 350 Club ("Submissions") are non-confidential, and that The 350 Club may use and share them without restriction, for any purpose, commercial or otherwise, without acknowledgement or compensation to you.
You acknowledge and agree that The 350 Club may, where required, preserve content, and may disclose content if required to do so by law or in the good-faith belief that preservation or disclosure is reasonably necessary to:
(a) comply with legal process, applicable laws or government requests;
(b) enforce these Terms;
(c) respond to claims that any content infringes the rights of third parties; or
(d) protect the rights, property or personal safety of The 350 Club and its Members.
Points (c) and (d) apply solely to Trust and Safety incident investigations. For more details, please see our Privacy Policy. You also understand that the technical processing and transmission of the Service, including your content, may involve transmission over various networks, and changes to conform and adapt to the technical requirements of connecting networks or devices.
Copyright complaints
If you believe your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have otherwise been infringed, please notify The 350 Club at [email protected].
16. General rules
The Club, the Proprietor, the Membership Committee and any employee or agent of the Club will not be liable for any act or omission of the Proprietor, the Club, any Member or any guest, and will be held harmless from any direct or indirect loss or damage suffered by any Member or guest, whether in contract or tort, under common law, statute, rule or any legal instrument, and whether the act or omission occurred before, during or after the Member's membership.
Nothing in these Rules excludes the Club's or the Proprietor's liability for death or personal injury caused by any negligent or unlawful act of the Club or the Proprietor.
The Club has a Privacy Policy that reflects the trust its Members place in it and its commitment to high standards of data protection.
Members agree to keep all passwords, user names and any other identifying information used on or in connection with the Club or its website (the "Access Profile") private and secure. The Access Profile is strictly personal and must not be shared with or disclosed to anyone else. Members understand that the Access Profile is confidential and that they will be held responsible for any damage caused by its use by any unauthorised person.
17. Alteration of Rules
Management, or its representatives or employees authorised to do so, may revoke, supplement or alter these Rules at any time at its sole discretion. Any revocation, alteration or addition will be deemed to have been brought to Members' attention once a copy is prominently displayed on the Club's official website.
18. Dissolution
The Proprietor may dissolve the Club at any time at its sole discretion.
19. Disputes and interpretation
Any dispute or difference arising in respect of these Rules, or in relation to membership or the operation of the Club, will be determined by Management, whose decision will be final and binding on all Members.
These Rules are governed by and construed in accordance with English law, and Members and guests agree to submit to the exclusive jurisdiction of the courts of England.
20. Event cancellation policy
Bookings for paid events will not be refunded if cancelled with less than one month's notice before the event's scheduled start time.

COOKIES AND PRIVACY
==================================================
Privacy policy
Welcome to the website (the "Site") of The 350 Club (the "Company", "we", "us" or "our"). Through our web application (the "App"), we enable users ("Members") to connect and hold conversations with colleagues, peers, and other board members and leaders in the FTSE 350 and associated spaces, in the UK and internationally, and to gain information for development, networking and career purposes (together, the "Service").
This Privacy Policy explains what Personal Data (defined below) we collect, how we use and share that data for the purposes of UK data protection law, and your choices about our data practices. This Privacy Policy is incorporated into and forms part of our Terms of Service.
Please review this Privacy Policy before using the Service or submitting any Personal Data to the Company. By using the Service, you agree to the practices described in this Privacy Policy.
1. Personal Data we collect
We collect information that, alone or in combination with other information we hold, could be used to identify you ("Personal Data"), as follows.
Personal Data you provide
We collect the following categories of Personal Data from you when you use our Service, including when you sign up for an account, create or share content, and message or communicate with others:
(a) Information you provide: We collect content, communications, career information and other information you provide, including when you sign up for an account, create or share content, take part in Club surveys, and message or communicate with others. To create and manage an account, you may provide Personal Data including your name, phone number, a photo of yourself, an email address and career details. We use your contact information to authenticate your account, keep it secure and communicate with you about the Service.
(b) Audio and video: The Company does not record room conversations. It may in due course record keynote events and interviews, solely to make them available privately to Members for later viewing, and only on the Site. Any keynote event or interview being recorded will be clearly flagged as such, and every speaker's permission will be obtained before the recording is uploaded to the Site. No content from event rooms will ever be made available to an external third party, unless Management is required to do so to comply with the law. The Site does not capture audio or video from (i) private room conversations, (ii) muted speakers or (iii) audience members.
(c) Networks and connections: We collect information about the Members, events and areas of the Site you are connected to, and how you interact with them through our Service. If you choose to upload information to the Site (such as by inviting contacts), we may use it to enhance your experience in various ways, including notifying you when a contact has joined a waitlist or the Service. We may also use your connections on the Site to recommend other Members you might want to follow, and to recommend you and your content to others.
(d) Usage: We may collect information about how you use our Service, such as the types of rooms you take part in, the content you share, the features you use, the actions you take, the people or accounts you interact with, and the time, frequency and duration of your use, in order to improve the quality of the Service we provide.
(e) Feedback: We may collect information when you contact us with questions or concerns and when you respond voluntarily to requests for your opinion and feedback.
(f) Social media data: We have pages on social media sites such as LinkedIn ("Social Media Pages"). When you interact with our Social Media Pages, we may collect Personal Data that you choose to provide to us. The companies that host our Social Media Pages may also provide us with aggregate information and analytics about their use.
(g) Payment information: We may in future charge for certain parts of the Service, or allow you to transact with other users on the Service. If so, we may ask you to provide the financial information needed for our payment processor to process payments. In addition to this Privacy Policy and our Terms of Service, information relating to your payments or purchases will be processed in accordance with our payment processor's services agreement and privacy policy.
Internet activity data
When you visit, use and interact with the Service, we may receive certain information about your visit, use or interactions. For example, to improve the Member experience, we may monitor the number of people who visit the Service, peak visiting hours, which pages are visited, the domains our visitors come from, which browsers people use to access the Service (for example Chrome, Safari or Firefox), broad geographical information and navigation patterns. In particular, the following information is created and automatically logged in our systems:
(a) Log data: Information that your browser automatically sends whenever you visit the Site. Log data includes your Internet Protocol (IP) address, browser type and settings, operating system, the date and time of your request, how you interacted with the Site, and how you interacted with mobile or email notifications.
(b) Cookies data: Please see the "Cookies" section below to learn more about how we use cookies.
(c) Device data: The name of the device, operating system and browser you are using. The information collected may depend on the type of device you use and its settings. This helps us improve the platform experience.
(d) Usage data: We may collect information about how you use our Service, such as the types of content you view or engage with, the rooms and features you use, the actions you take, and the time, frequency and duration of your activities.
(e) Email open and click data: We may use pixels in email campaigns that allow us to collect your email address and IP address, and the date and time you open an email or click on any links in it.
Personal Data collected from third parties and publicly available sources
When you create your account, or if you authenticate with a third-party service (such as Facebook), we may collect, store and periodically update information associated with that third-party account, such as your lists of friends or followers. We will never publish anything through any of your third-party accounts.
Derived data
We may infer your preferences for content and features of the Service, or for future products and services, from the Personal Data we collect about you.
Cookies
We may use cookies to operate and administer our Site, gather usage data and improve your experience. "Cookies" are small text files containing a string of characters that can be placed on your computer or mobile device and that uniquely identify your browser or device. Cookies can be stored on your computer or mobile device for different periods. Some expire after a certain time or when you log out (session cookies). Others survive after your browser is closed until a defined expiry date set in the cookie (as determined by the third party placing it), and help recognise your computer or mobile device when you open your browser and browse the internet again (persistent cookies).
Cookies and other technologies allow a site or service to know whether your computer or device has visited it before. These technologies can then be used to deliver products or services, help us understand how the site or service is being used, help you navigate between pages efficiently, remember your preferences and generally improve your experience of our services. If you limit the ability of websites to set cookies, you may be unable to access certain parts of the Site or benefit from its full functionality.
Advertising networks may use cookies to collect Personal Data. Most advertising networks offer a way to opt out of targeted advertising.
If you access the Site on a mobile device, you may not be able to control tracking technologies through your settings.
Analytics
We may use web analytics services, such as those provided by Google, which use cookies to help us analyse how users use the Site and to enhance your experience of it. For more information on how Google uses this data, go to www.google.com/policies/privacy/partners/.
Online tracking and Do Not Track signals
We and our third-party service providers may use cookies, pixels or other tracking technologies to collect information about your browsing activity over time and across different websites after you use the Site. We make reasonable commercial efforts to recognise and support "Do Not Track" signals.
2. How we use Personal Data
We may use Personal Data for the following purposes:
(a) to provide the Service;
(b) to create your account, facilitate network and other connections on the Site, recommend content such as events and vacancies, and further personalise the Service for you, on an opt-in or opt-out basis;
(c) to respond to your enquiries, comments, feedback or questions;
(d) to send you administrative information, for example about the Service and changes to our terms, conditions and policies;
(e) to analyse how you interact with our Service so that we can improve it;
(f) to maintain and enhance the Service;
(g) to develop new products and services;
(h) to authenticate your account and keep it secure;
(i) to enforce our Terms of Service;
(j) to prevent spam, fraud, abuse, criminal activity or misuse of our Service, and to ensure the security of our IT systems, architecture and networks; and
(k) to comply with legal obligations and legal process, and to protect our rights, privacy, safety or property, and those of our affiliates, you or other third parties.
Aggregated information
We may aggregate Personal Data and use the aggregated information to analyse the effectiveness of our Service, to improve it and add features, and for similar purposes. From time to time, we may also analyse the general behaviour and characteristics of users of our Service and share aggregated information, such as general user statistics, with prospective business partners. We may collect aggregated information through the Service, through cookies and through other means described in this Privacy Policy.
3. Sharing and disclosure of Personal Data
We will never sell or in any way misuse your Personal Data.
In certain circumstances, we may share the categories of Personal Data described above with the following categories of third parties without further notice to you (subject to legal requirements):
(a) Vendors and service providers: Where necessary to deliver our Service effectively and meet our business operations needs, we may share Personal Data with vendors and service providers, including providers of hosting services, audio and video applications and infrastructure, cloud services and other information technology services, event management services, email communication and newsletter services, payment processing, customer relationship management and customer support services, and web analytics services. On our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us. We take commercially reasonable steps to ensure our service providers meet the security standards we apply to your Personal Data.
(b) Business transfers: If we are involved in a merger, acquisition, financing due diligence, reorganisation, sale of all or part of our assets, or transition of service to another provider (each a "Transaction") under which the Service is intended to continue, your Personal Data and other information may be shared in the due diligence process with counterparties and others assisting with the Transaction, and transferred to a successor or affiliate as part of that Transaction along with other assets, so that the Site can continue to offer its service.
(c) Legal requirements: Where required to do so by law, or in the good-faith belief that such action is necessary to (i) comply with a legal obligation, including national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Service or the public, or (v) protect against legal liability.
(d) Other users: Certain actions you take may be visible to other users of the Service. For example, when you upload a profile photo or update your career or contact details or bio, other users will be able to see that content and information.
4. Data retention
We keep Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy and while we have a business need to do so, or for as long as required by law (for example, for tax, legal or accounting purposes), whichever is longer.
5. Updating your information
Please log in to your account or contact us at [email protected] if you need to change or correct your Personal Data, or if you wish to delete your account.
6. Your privacy rights
Where provided for by law, and subject to any applicable exceptions, UK residents may have the right:
(a) to know the categories of Personal Data the Company has collected about you, the business purpose for collecting it, and the categories of sources from which it was collected;
(b) to access the specific pieces of Personal Data the Company has collected about you;
(c) to know whether the Company has disclosed your Personal Data for business purposes, the categories of Personal Data disclosed, and the categories of third parties to whom we have disclosed it; and
(d) to have the Company, in certain circumstances, delete your Personal Data.
If you would like to exercise any of these rights, please contact us at [email protected]. Once we receive your request, we will verify your identity by emailing the address you provide to us.
7. Children
Our Service is not directed at individuals under the age of 18, and the Company does not knowingly collect Personal Data from them.
8. Links to other websites
The Service may contain links to websites not operated or controlled by the Company, including those of board services providers ("Third Party Sites"). Information you share with Third Party Sites is governed by their own privacy policies and terms of service, not by this Privacy Policy. By providing these links, we do not imply that we endorse or have reviewed these sites. Please contact Third Party Sites directly for information on their privacy practices and policies.
9. Security
You use the Service at your own risk. We implement commercially reasonable technical, administrative and organisational measures to protect Personal Data, online and offline, from loss, misuse and unauthorised access, disclosure, alteration or destruction. However, no internet, audiovisual or email transmission is ever fully secure or error-free. In particular, email sent to or from us may not be secure, so please take special care in deciding what information you send to us via the Service or by email. In addition, we are not responsible for the circumvention of any privacy settings or security measures on the Service or on third-party websites. Finally, while we do our best to verify identities and protect Members, we cannot control the actions of prospective Members on the platform who may use third-party apps or devices to record, store or share content or communications without other users' prior consent, in breach of our strict rules and cultural standards. Please keep this in mind when using the Service.
10. International users
By using our Service, you understand and acknowledge that your Personal Data will be transferred from your location to our facilities and servers in the UK and, where applicable, to the servers of the technology partners we use to provide our Service.
11. Your choices
In certain circumstances, providing Personal Data is optional. However, if you choose not to provide Personal Data needed for some features of our Service, you may be unable to use those features or the Service as a whole. You can contact us to ask us to update or correct your Personal Data, and you may delete your account. Please note that we will need to verify that you have authority to delete the account, and that certain activity generated before deletion may remain stored by us and may be shared with third parties as described in this Privacy Policy.
12. Changes to this Privacy Policy
The Service and our business may change from time to time, so we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another form of notice is required by law. By continuing to use our Service or providing us with Personal Data after we have posted an updated Privacy Policy, or otherwise notified you of it where applicable, you consent to the revised Privacy Policy and the practices it describes.
